SOCIAL SECURITY I don’t know why Social Security turns down disabled folks… I only know what to do about it! You’ve got to get your case out of the hands of the local office and into the hands of a fair-minded judge who will listen to you and to the evidence. You’ve got to get this to the Hearings and Appeals office. Lawyers like me will do this for you. We will look over the complicated laws and regulations that apply to your problem. We will find the evidence that shows whether you’re disabled. (What you think is evidence may not be evidence to the judge.) Social Security law says you’re disabled if you can’t work at pretty much any job for twelve months or longer. Showing that “Nobody will hire me like this” is not enough proof no matter how true. You have to show that even if someone would give you a break, you couldn’t take the job. And, the jobs they’re talking about are not jobs around here necessarily. The jobs are jobs described in a government book that may or may not have anything to do with the real world. In short, you must prove you cannot do jobs that may or may not exist. Do you begin to see why folks get turned down without knowing why? If you just want to talk about how sick or hurt you are, there are fourteen sections on something called listed impairments. These are found in the appendices to the regulations, which came from the law. If you don’t know what’s in the back part of the regulations, you will lose. If you don’t what’s there and how to prove it, you will lose. I wish it was different but in the real world when a huge bureaucracy like Social Security gets involved, you better be able to help yourself or have someone wave a flag to show them the right way. If you can’t get their attention, you will get lost in the sea of paperwork and regulations. This is not a place for a newcomer. You wouldn’t want your case to be your lawyer’s first case. You would worry if he knew what he was doing. Well, anybody who tries to handle their own appeal is like that lawyer with his first case. Only, you don’t know the law if you’re trying your own case.
